而在实际交易过程中，如果是由于中介的原因造成最终未能完成过户，则无需交中介费；如 果是由于买卖双方的原因造成最终未能 完成过户，则要支付部分甚至全部中介费。目前买房人与中介签订的居间合同，中介只 负责到买卖双方签完合同，而不是以完成过户才能收取中介费。中介承诺未兑现应退还中介费在北京版国五条政策落地前，为了避免交纳20%的个人所得税，北京的二手房市场曾掀 起过一波购房高潮。王先生就抢在国五条政策执行之前买了一套二手房，当时中介承诺可以 在政策执行之前为王先生完成过户手续，并将这一承诺写进了居间合同之中，因此王先生就 与业主签订了二手房买卖合同并交付了中介费以及定金。但是由于各种原因，最终未能在政 策执行前完成该套房屋的过户手续。新政策执行后，由于该套房屋不满五年需交纳差额的20% 的个人所得税。算下来，个人所得税要交20万元。面对这笔高额的个人所得税，王先生表示 无力承担。业主也表示不会为个税买单，在该套房屋买卖无法进行下去的情况下，王先生提 出解除买卖合同，并要求中介退还中介费，理由是中介在买房前曾承诺过可以在政策执行前 完成过户，但最终并未兑现承诺。但中介却以未能在新政策执行前完成过户是由于王先生的 原因造成，拒不退还中介费。在这种情况下，王先生的中介费还能要得回来吗？ 买房人原因造成房产不能过户中介费不退 石先生在前不久通过一中介公司在望京购买了一套二手房，在签订二手房买卖合同以及 与中介的服务合同之前，中介公司要求石先生先签一个声明：表示自己确认有购房资格，如 购房资格出现问题导致无法过户责任由买方自负。石先生当时十分自信购房资格没问题，没有去确认自己的个税和社保是否满五年。但是 当签订了二手房买卖合同后并交纳了中介费和定金后，在办理房屋过户时却发现自己的社保 曾经因为工作变动断过，因此他不具备购房资格，他要买的二手房无法过户到其名下。在买 卖无法继续的情况下，石先生要求解除合同并要求中介退还中介费，但遭到了中介的拒绝。 中介的理由是房屋无法过户的责任在石先生自己，中介没有任何过失。业主违约致交易失败，买房仍要支付部分中介费 2012年9月17日，郭女士与业主何先生在中介公司的居间服务下签订了二手房买卖合 同。同日，郭女士支付了2万元购房意向金，并在中介费确认书上签字确认中介费为2 万元。而后，因业主何先生一方违约，未能继续履行该合同，郭女士的购房计划也宣告“破 产”。何先生返还郭女士已支付的2万元意向金，并补偿违约金2万元。 因房子未买成，郭女士认为不应向中介支付，双方经协商未果，中介公司于2013年1 月将郭女士诉至法院，要求其支付佣金2万元。 一审法院审理认为，郭女士通过居间方购房的合同目的并未实现，但中介公司已提供了 一定的居间服务，可收取相应佣金，判决郭女士向中介公司支付6000元。郭女士不服，提起 上诉。 法院二审认为，依据法律规定，居间人促成合同成立的，委托人应当按照约定支付报酬。 该案中，郭女士经中介公司居间介绍与案外人签订房地产买卖合同，中介公司有权依据上述 规定要求郭女士支付居间报酬。需要说明的是，根据居间合同，中介公司在促成郭女士与案外人买卖合同成立后，尚须协助办理相关抵押注销、合同公证、见证、评估、产权过户、贷款、领取产证、交房等相关手续，在郭女士与案外人 签订的买卖合同并未实际履行的情况下，中介公司客观上无需再履行该等义务，其有权主张 的居间报酬相较于交易全部完成的情况，应当予以部分减免。因此，一审法院结合该案具体 情况，将居间报酬酌情确定为6000元并无不当。故上二审判决驳回上诉，维持原判。 目前的格式合同 买卖双方一签约即便没完成过户也不影响中介收费 当前的二手房市场上使用的居间合同,对于中介责任的完成不以网签或过户为准，而是以 买卖双方签订二手房买卖合同为准。也就是说，只要双方签订了二手房买卖合同，中介的职 责就已经完成，按目前的格式合同规定，中介就可以收取中介费了。这也就造成了在上述案 例中，有的买房人最终没能买到房子但还是得交纳中介费。这对于很多买房人来说是难接受 和理解的。 因此，有人建议对市场上使用的二手房买卖的居间合同进行修改，明确规定只有当完成 过户后中介方可收取费用，如未能完成过户，中介不得收取任何费用。对此，中介方面提出 异议，对于中介已经做了大量工作，但因买卖双方原因导致的未能完成过户的情况，如不收 取任何费用也有失公平。 在当前二手房市场上使用的居间合同都是以双方签订二手房买卖合同为准的情况下，建 议买房人在买房前要先与中介公司协商签订补充协议，尽量把双方的责任和义务约定得越详 细越好。甚至可以与中介协商约定在完成过户后方可收取是中介费，在未完成过户前不得收 取任何费用。 材料二： 居间合同是居间人向委托人报告订立合同的机会或者提供订立合同的媒介服务，委托人 支付报酬的合同。居间人未促成合同成立的，不得要求支付报酬，但可以要求委托人支付从 事居间活动支付的必要费用。本案中，房屋的交易并未成功，同时买卖双方对中介费用作了 明确的约定由违约方承担。同时根据民事诉讼法、最高人民法院关于民事诉讼证据的若干规定相关规定，当事人对自己提出 的诉讼请求所依据的事实或者反驳对方诉讼请求所依据的事实有责任提供证据加以证明。没 有证据或者证据不足以证明当事人的事实主张的，由负有举证责任的当事人承担不利后果。材料三：脱离中介、自行交易，仍需支付中介费-上海青浦区法院 通过中介公司，李先生和陈先生签订了房产转让合同。可是为了逃避支付房产咨询服务 费，两人竟背着中介公司进行房产过户。为此，中介公司将李先生和陈先生告上法庭。日前， 青浦区法院开庭审理此案，判决李先生和陈先生各支付中介公司服务报酬1.5万元。住在农村的李先生想在青浦城区买一套二手房，于是他找到位于浦仓路的一家房产中介 代为找房。去年5月23日，中介带着李先生来到卖房方陈先生家看房。李先生对房屋各方面 都比较满意，双方以179万余元的价格成交。当晚，李先生与陈先生就在中介公司签订了房 产转让合同。 当月28日，李先生到中介公司支付购房款38万元首付款。可是由于贷款迟迟没有办下， 李先生与陈先生协商后决定要放弃买卖房屋，并由陈先生到中介公司取回房产证办理退税手 续。中介公司觉得事有蹊跷，通过对该房屋房产登记情况查询得知两人已办理了房产转让， 于是向法院提起诉讼。 法庭上，陈先生辩称：当初的确取消了买卖交易，但是后来李先生又通过其他中介凑足 了房款后找到自己的，所以双方就以现金购买的方式达成了买卖协议。李先生则辩称：因为 贷款办不下来，所以三方都同意终止交易。后来遇上了开中介的朋友表示可以帮忙解决房款 事宜，而陈先生也在这家中介挂牌出售该房屋，所以又重新达成交易。法院审理后认为，陈先生和李先生都确认是从中介公司获得对方的联系方式以及带领看 房、签约、见证支付部分房款等过程，据此可排除两人从其他中介获得交易信息的可能；其次，从两人后续签订的买卖合同内容看，其吸纳了先前合同的主要条款，并对该合同的履行 予以确认；再次，虽然陈先生陈述从中介公司取回房产证时告知中介不再进行交易，然各方 均确认取回房产证是为办理退税事宜，仅此并不足以证明该居间协议已解除；最后，所涉房
