Before sign this Agreement, Party A shall show Party B Property Certificate, No. , and with mortgage. 二、租期租 :Term of Tenancy:2.1 租赁期为 2 年,自 200 年 月 日起至 20 年 月 日止。该租赁为非固定期限,即在此期间乙方可以任何时候提前一个月通知甲方的前提下终止合同而不承担违约责任,即乙方最早可于 20 年 月 日提出退租,并于 20 年月 日正式退租。若通知期不足一个月的,则乙方需补足通知期不足天数的租金作为赔偿。则乙方可按 2.2 条使用押金。在乙方将全部因乙方租客实际使用而产生的水、电、燃气等杂费及电话费付清合同范本2 Contract: 合同范本后的十个工作日内将全部剩余押金(如有,不计利息)退还给乙方。The above property is hereby leased for a term of two year, commencing on and expiring on . Its the free term, Party B can early terminate the contract by serving Party A one month prior notice without bearing any liability of the breach, that means Party B can earliest issue the termination notice to Party A on and then terminate the contract formally on . In case the notifying period is less than one month, Party B shall make up the rental for the insufficient days of the notifying period as the compensation. Then, Party B can deal the deposit as item2.2. Party A shall return Party B the rest of the security deposit (if has, without interest) within ten working days after Party B payoff all water, gas, electricity and telephone fees as tenant actual use. 如有免租期:甲方同意在本租赁协议经双方签署后,于 年 月 日前将该房产交于乙方租客居住,乙方不用承担自交房日至 200 年 月 日期间的房屋租金,但乙方须承担在此期间因租客实际使用而产生的水、电、燃气、电话费用。After the Agreement signed by both parties, Party A agree to handover the Property to Party B to live before . Party B wont bear the rent from the delivery date till ; but shall pay the utility fees like water, gas, electricity and telephone fees occurred by the actual use of Party Bs tenant during the term. 2.2 (a) 在租期结束前二个月,乙方可用押金抵做租金,同时在合同结束时,乙方须付清因乙方租客实际使用而产生的全部水,电,燃气等杂费及电话费。Two months prior to the expiration of the lease term, Party B can use the security deposit to counteract the rentals. Meanwhile, Party B shall pay off water, gas, electricity and telephone fees occasioned by the actual use of Party Bs tenant at the expiration of the contract. (b) 租期届满,乙方如不再续租,甲方应在租赁期结束后, 并在乙方将付清因乙方租客实际使用而产生的全部水,电,燃气等杂费及电话费后的十个工作日内将押金退还(不计利息)给乙方。On expiry of the lease and the lease is not going to be renewed, Party A must refund the paid deposit in full to Party B (without interest) within ten working days after the termination of the Tenancy Agreement and subject to the condition that Party B shall pay off water, gas, electricity and telephone fees occasioned by the actual use of Party Bs tenant。2.3 租期届满,甲方有权收回出租房屋及全部家俱、电器(包括附件二所例所有家具、设备),乙方亦应如期交还; 乙方如要求续租,则享有优先续租权,但必须在本租合同范本3 Contract: 合同范本约期满前一个月向甲方提出书面申请,租金双方另行协商。On expiry of this lease, Party A has the right to take back the leased property (including all the furniture, fittings and equipment listed in Appendix II)in full, and Party B must deliver the leased property on the date of expiry. If Party B wishes to extend the lease, Party B shall have the priority to renew the lease with one-month advance written notice to Party A. The revised rental shall be negotiated between the two parties. 三、租金租 :Rent:3.1 租金每月为人民币 (大写:_),包括物业管理费,房租发票,有线卫星电视收视费,长途电话及宽带安装费,会所家庭会员卡。The rent is per month, including management fee; invoice, cable and satellite TV using fee, IDD line,ADSL installation fee and the membership card fee. 32 租金每月支付一次。甲方在每月付租金日(每月_日)之前二十个工作日向乙方发出付款通知,及开具上海市房屋租赁发票。乙方在收到付款通知书及上海市房屋租赁发票后的二十个工作日内, 安排租金汇入指定帐户。Party B shall make payment on the monthly basis. Party A shall deliver the debit note and issue Shanghai Property Lease Tax Invoice to Party B twenty working days prior to the payment date of every month, receiving which Party B should arrange to remit the rental to the designated account within twenty working days. 3.3 本租约签订后的第一个月租金, 乙方应于签约后 10 个工作日内全额到付给甲方。Part B shall pay the rent for first month in full within 10 working days after signing of the Agreement. 3.4 在本租约有效期内 即 年 月 日至 年 月 日,未经双方协商同意,租金不予调整。The rent cannot be adjusted without agreement with both parts during the term of this Tenancy Agreement(from to ). 四、押金押 :Deposit:4.1 自本租约签订之日起 10 个工作日之内,乙方应向甲方缴付相当于两个月租金额的租赁押金计人民币 。除本合同另有规定外,租赁关系终止时,甲方必须按本合同范本4 Contract: 合同范本4.2 4.3 4.4 合同第 2 条规定退还保证金给乙方。Within 10 working days after signing of this Tenancy Agreement, Party B shall pay to Party A two months rent as deposit, which is equivalent to RMB in total. On expiry of the lease and the lease is not going to be renewed, Party A must refund the paid deposit in full to Party B as per the regulation stipulated in Clause 2 of the contract. 乙方如违反租约规定,致使甲方未能如期收取租金或因而发生其他费用开支的,经甲方发出催收通知后,乙方仍未能支付的,甲方有权据此以押金抵付应付租金或因此而发生的其他费用。If Party B breaches any part of this Agreement, and causes Party A unable to receive rent payment on time or causes additional cost to Party A. Party A is entitled to retain the deposit as compensation of said fees. 发生 4.2 条款情况,且押金不足抵付时,乙方必须于接到甲方付款通知后十个工作日内补足应付款项。In case the deposit is insufficient to cover Party As expenses due to Clause 4.3, Party B shall have to pay the extra amount to Party A within ten working days after receipt of Party As written notice. 押金以人民币支付,甲方收到押金后十个工作日内应向乙方开具收据。The deposit is paid by RMB. Party A shall issue a receipt on receiving of the deposit within 10 working days . 五、其它费用其它费 :Other Charges:5.1 乙方在租赁期内所用的水、电、煤气, 管理公司每月按实际耗用量结算,乙方按相关部门帐单缴付。During the period of tenancy, Party B shall pay monthly all charges for usage of water, electricity and gas based on the actual consumption amount billing from related departments. 5.2 乙方所用电话按电讯局标准收费,每月根据实际用量结算,乙方按单缴付。All telephone charges shall be paid by Party B and based on the actual usage according to the Telecommunication Bureau standard tariffs on receipt of the bills. 六、甲方的责任甲方的责 :5合同范本Contract: 合同范本Landlords Responsibilities:6.1 本租约签订后,甲方不得在租赁期内(200 年 月 日起至 20 年 月 日)无故收回房屋,如甲方中途要求收回房屋,乙方有权拒绝。Party A is not permitted to take back the leased property during the term of contract (from to )without any reason. If Party A wishes to do so, Party B has the absolute right to refuse. 6.1-1 如乙方同意解除租约且乙方已按 4.1 条约定交纳租金及押金并已入住, 则甲方必须,双倍返还乙方已付押金并退还乙方已付未住的租金,本租约于甲方发出解约通知三个月后终止。If Party B agrees to terminate the Agreement whereas Party B has paid the rent and deposit according to Clause 4.1 and has moved in to the properties, Party A shall return the deposit twice as much as the original amount to Party B as well as returning the pre-paid rental for the unoccupied term, and the Agreement will be terminated three months later after Party A issues the notice. 6.1-2 如乙方同意解除租约且乙方已按 4.1 条约定交纳租金及押金但尚未入住, 则甲方必须,双倍返还乙方已付押金并退还乙方已付未住的租金, 本租约终止。If Party B agrees to terminate the Agreement whereas Party B has paid the rent and deposit according to Clause 4.1 but has not moved in the property, the Agreement will be terminated after Party A return the deposit twice as much as the deposit which Party B has already paid as well as returning the pre-paid rental for the unoccupied term. 6.1-3 本租约签订后, 乙方未交纳租金和押金前, 若甲方欲解除本租约 , 则应向乙方支付相当于贰个月租金的赔偿金. If Party A wants to rescind the Agreement after the signature of this Agreement, and Party B has not pay the rent and deposit by that time, the Agreement can be terminated only after Party A has paid two months rent to Party B as compensation. 6.2 督促管理公司提供充分的保安, 消防工作及安静清洁的居住环境。To supervise the estate management office to provide adequate security, fire prevention and quiet or Party B shall be entitled to suspend the payment of the rental till Party A is available to be reached. If Party A has the behavior to transfer the property, Party A shall write clearly in the transfer contract that the new owner of the property shall abide by this provision; or Party A shall still be deemed as the breach of the contract and Party B shall be entitled to suspend the payment of the rental. 6.11 甲方承诺并保证在本合同订立之前、之时和/或之后的任何时间不得未经书面通知乙方,在本合同约定之外,向乙方的任何雇员、租客,和与他们有利害关系的任何其他人(包括配偶和近亲属)提供或支付任何形式的回扣、房租折扣、便利、好处或其他优惠(包括但不限于现金、实物、家具、装修和/或服务)At any time before signing, of signing and /or after the signing the contract and without forwarding the written notice to Party B, Party A consents and guarantees not to outside the stipulation of the contract provide and pay to any employee, tenant of Party B, and any other person that have advantages and disadvantages relationship with the employee and tenant (including the spouse and close relative) the rebate, rental discount, advantage, benefit or other preferential in any form (including but not limited to cash, material object, furniture, decoration and/or service ). 6.12 征得甲方的书面同意后,乙方租客在墙上打钉挂画而无须承担因此而引起的赔偿责任。Upon getting Party As written consent, Party B could put the nails on the wall for hanging painting and shall not take any responsibility for compensation occasioned hereby. 6.13 甲方将负责整个花园的花草树木的养护工作,如发生树木自然死 亡事件,甲方将负责重新植树工作(树木的种类由出租方决定)。 如草坪出现荒芜、稀疏现象,出租方将负责重新铺植草坪的工作,并承担以上工作所需费用。Party A shall be liable to the maintenance of the flowers, grasses and trees in the whole garden. If there occurs any natural death of the trees, Party A shall be responsible for 9合同范本Contract: 合同范本replanting new ones (the kinds of trees are up to the Party A). If the lawn happens to be barren and sparse, Party A shall be responsible for replanting the lawn and bearing the cost for the aforesaid work. 七、乙方责任乙方责 :Tenants Responsibilities:7.1 乙方应按本租约第三、五条约定,按期交纳租金及其他费用,如出现迟延支付的情形,在甲方发出催收通知后的合理期限内,仍未支付的,甲方有权以乙方已付押金抵付;若其已付押金不足以抵付,则甲方有权按 4.3 条的约定要求乙方限期补足;若超过限定期限 30 天,乙方仍未支付的,则甲方有权解除本租约。Party B should promptly pay the rent, deposit and other charges as set out in Clauses 3 and 5 of the Agreement. In the event that Party B fails to pay the rent and any of the charges according to the time limit and methods as specified in this Agreement, Party A has the right to deduct from the deposit for such losses and damages suffered and expenses incurred. When the deposit is insufficient for reasons herein, Party A has the right in accordance to Clause 4.3, request Party B to make-up the deposit to full amount within the time limit. If Party B fails to bring up the deposit to the full amount for over thirty (30) days after the time limit, Party A has the right to terminate this Agreement. 7.2 本租约签订后, 若乙方未按本租约的约定支付首月租金及押金,且在甲方发出催收通知三十日后仍未支付的,甲方有权解除本租约, 同时有权向乙方索取相当于贰个月租金金额的赔偿金。In the event that Party B fails to pay the rent for the first month and deposit according to the stipulation of this Agreement for more than 30 days after the execution of this Agreement, Party A is entitled to terminate this Agreement without prior notice, and at same time Party B should pay two months rental to Party A as compensation. 7.3 未经甲方书面同意,乙方不得将所租房屋分租或转租给第三方及与第三方以任何方式共用该房屋,但乙方公司或乙方相关联公司的员工及其家属除外;若出现上述情形,在甲方发出改正通知书后的合理期限内,乙方仍未能纠正其行为,甲方有权解除本租约。During the period of Tenancy, unless with written consent from Party A, Party B shall not transfer or sublease the Property in whole or in part or in any manner whatsoever share the use thereof in common or jointly with any third party, but the employee of Party Bs company or Party Bs relevant company is excepted. Otherwise Party A has the right to terminate the Agreement. 1合同范本0 Contract: 合同范本7.4 7.5 7.6 7.7 7.8 除房内已有的装饰和设施之外,乙方如要甲方增加新设备须征得甲方同意。乙方应爱护房屋及其设备,如因明显违反使用操作而导致损坏,乙方应负责修复或赔偿(自然损耗除外)。Save for the current fitting and facilities in the Premises, Party B shall get Party As consent for adding new equipments. Party B must take good care of the property and its contents, otherwise Party B should repair or pay compensation to Party A for the damage caused by his improper use of the property (fair wear and tear excepted). 甲方有正当理由需要对该租赁房屋进行必要的维修或修复工作时,在取得乙方的同意后, 甲方或其代理人可以在合理的时间内进入及巡视房屋,进行必要的维修或修复工作;在租赁期最后一个月内,在征得乙方同意后,甲方或其代理人可以带领有意租赁或购买房屋的客人在合理的时间内视察房屋,但乙方已按第 2.3 条书面通知甲方将续租的除外。With Party As notice in advance, Party B should permit Party A and person authorized by Party A under reasonable circumstances to enter and view the leased property, to carry out any work and repairs which is deemed necessary. During the last one month of the Agreement, Party A has the right to show the leased property to prospective tenants or purchasers at reasonable time, unless according to clause 2.3, Party B has informed Party A of its intention to renew the Lease. 在未经甲方书面同意下,乙方不得擅自设立、安装或移动会造成房屋构造破坏设施及设备,不能擅自设立隔断,不得擅自对房屋的结构改动或增加。Not to erect, install or remove any fixtures or partitioning, or to make any structural additions and alterations without the prior written consent of Party A. 租赁房屋过程中,必须严格遵守中华人民共和国的有关法律、细则、规章及法令的规定, 并严格禁止乙方利用房屋进行违犯法律及不道德的行为。Strictly to comply and adhere in the use of the leased property according to all laws, regulations and decrees of the Peoples Republic of China, and specifically not to permit the leased property to be used for any purpose that is unlawful or immoral. 房屋除供乙方居住之外,未经甲方书面同意,房屋不可作办公或协议未曾说明之用。但若乙方提出改变该房屋使用用途之请求,则甲方不应不合理地拒绝该请求。To use the leased property exclusively for residence of his family and not to use the leased property as office or for any other purpose without the prior written consent of Party A. In case Party B submits the requirement to change the use of the Premises, such requirement shall not be unreasonably withheld. 合同范本11Contract: 合同范本注:乙方须在入住前到有关部门(或物业管理公司)办理临时居住登记手续。Party B should go to the management office to register before Party B moves into the property. 八、房屋不能居住时其他事件Other things:房屋由于火灾、战争等不可抗力因素造成房屋毁坏而不能被正常使用及居住时,乙方从该日起停止支付租金,直至房屋依据该合同的约定可再被使用及居住时为止。甲、乙方也可根据自己的意愿及经济、实际意义等原因,是否继续履行本合同等事项进行协商。若未对继续履行本合同达成合意,则在一方书面通知终止本合同的十天之内,甲方应将押金及已付未住的租金全部退还乙方。If the leased property are substantially destroyed or damaged by fire, bad weather, war, or other causes beyond the control of Party A and not attributable directly or indirectly to the negligence or malice of Party B or are otherwise rendered unfit for use or occupation, the rent shall cease to be payable from the date the leased property become unfit for use or occupation until the leased property shall again be rendered accessible and fit for use, however, that the Party A shall be under no obligation to repair the leased property, when in Party As opinion, it is not reasonably or economically or practically to do so. If such an event occurs, Party A shall give a written notice to Party B, and the deposit and the rest of rent paid by Party B shall be returned in full within 10 days of said notice. 九、适用法及争议的解决:Legislation (ii) facsimile or email message sent to the person to be notified; (iii) or any other manner that provides a written record of its contents. Notice by registered mail shall be deemed to have been received by the other party seven days after delivery. Notice by facsimile or email shall be deemed to have been received by the other party upon electronic confirmation of delivery. Notice by any other means shall be deemed to have been received by the other party at the time of actual delivery to the addressee. The Occupants shall be the representatives of Party B for the purposes of receipt of any notice in relation to the performance of this Agreement. If one party has the amendment, it shall inform the opposite party in written within five working days, or it shall be deemed as the breach. 10.4 中英文条款及意思如有不一致之处, 以中文为准。In the event that there is any disagreement between the Chinese version and English version, the Chinese version shall prevail. 13合同范本Contract: 合同范本10.5 本租约如有未尽事宜,由甲、乙双方洽谈解决。If the contract remains with any outstanding matters, the two parties shall negotiate and resolve peacefully. 本租约于 2006 年 月 日在上海签订.
