精选资料Shanghai Premises Lease/Commercial Residential Building Pre-lease Contract上海市房屋租赁/商品房预租合同 (Contract No.: ) (合同编号: )Parties to this Contract:本合同双方当事人:Lesser(hereinafter referred to as Party A):【出租】 出租方(甲方):ZHONG JIN FENG 钟金凤Lessee(hereinafter referred to as Party B):【承租】 承租方(乙方):According to and (hereinafter referrec to as the Regulations), Party A and Party B have reached an agreement on the matter concerned Lease (Lease/Pre-lease)of the (Commercial Residential Building),which Patty A has the right, through friendly consultation over the following terms and conditions.根据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例)的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依法 出租 (出租/预租)的 商品房 (房屋/商品房)事宜,订立本合同。Article 1 Descriptions of the House to Lease一、出租或预租房屋情况1.1 Party A will rent to Party B the house which is located at 26A Apt. 138 (Bldg/No.) (Lane/New Village) Qinghai Rd., JingAn (District/Country) Shanghai (Hereinafter referrec to as“the premises”).The floorage of the premises (the actual for lease and the reckoned for Pre-lease) is 141.15 square meter. The purpose of the premises use is living .The type of the premise is New Apt and structure is .The ichnography of the premises is referred to the attachment 1 of this contract. For this contract, Party A has brought forth documents to Party B as bellowing:甲方 出租 (出租/预租)给乙方的房屋座落在本市 静安 (区/县) 青海 路 (弄/新村) 138 (号/幢) 26A 室(部位) (以下简称该房屋)。该房屋 出租 (【出租】实测/【预租】预测)建筑面积为 141.15 平方米,房屋用途为 居住 ,房屋类型为 新工房 /结构为 钢混 。该房屋的平面图见本合同附件(一)。甲方已向乙方出示;i) In case of lease, Property Right Certificate/Property Ownership Certificate/ ,the No. of the certificate is .【出租】房地产权证/房屋所有权证/ 房地产权证 ;证书编号: 沪房地静字(2003)第002106号ii) In case of pre-lease, the No. of the Pre-purchase Certificate is .【预租】预售许可证证书编号: 。1.2 The relationship of lease is established between Party A, as the Property Owner/Custodian/other obliges authorized by Law, and Party B. Prior to sign this Contract, Party A has notified Party B that there is (is/is not)mortgage on the premises.甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 未 (已/未)设定抵押。1.3 The following matters should be clearly set forth by the two parties in the attachment 2 & 3 of this Contract, and the two parties agree to consider these two attachments as the preconditions of acceptance in case that Party A deliver the premises to Party B and Party B return the premises to Party A when this Contract is terminated:甲、乙双方需约定的如下有关事宜,由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。i) The usable area, conditions and requirements for public use and/or mutual use;该房屋的公用或合用部位的使用范围、条件和要求;ii) The conditions of the existed decorations, facilities and equipments;现有装修、附属设施、设备状况;iii) The types,standards and other matters which should be stipulated concerned that Party A agrees Party B to equip by himself and add other facilities.甲方同意乙方自行装修和增设附属设施的内容、标准;Article 2 Purpose of the Leased Premises二、租赁用途2.1 Party B promises to use the premises as Living and comply with the regulationgs constituted by Shanghai or the Country concerned using the premises and the properly management.乙方向甲方承诺,租赁该房屋作为 居住 使用,并遵守国家和本市有关房屋使用和物业管理的规定。2.2 Party B promises not to alter the usage of the premises specified in the above article without the written authorization by Party A and the approval by related government according to certain regulations.乙方保证在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前,不擅自改变上款约定的使用用途。Article 3 Date of Delivery and the Term of Lease三、交付日期和租赁期限3.1 The two parties agree that Party A should deliver the premises to Party B prior to the term is calculated from 12 / 4 / 2011 (Date/Month/Year) to 11 / 4 / 2012 (Date/Month/Year). In case of pre-lease, the term is calculated from the date of signature of the delivery documents of the commercial residential building for pre-lease to / / (Date/Month/Year).甲、乙双方约定,甲方与 2011 年 4 月 12 日前向乙方交付该房屋。【出租】房屋租赁期自2011 年 4 月 12 日起至2012 年 4 月 11 日止。【预租】房屋租赁期自预租商品房使用交接书签订之日起至 年 月 日止。3.2 On expiration of the Contract, Party A shall have the right to claim back the premises, and Party B shall return the leased premises in time. Party B should send Party A a letter of in intent one months in advance if the former finds it necessary to renew the Contract can proceed with the consent of Party A.租赁期满,甲方有权收回该房屋,乙方应如期返还,乙方需继续承租该房屋的,则应于租赁期届满前 壹 个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。Article 4 Rental, Payment and the Term四、租金、支付方式和期限4.1 The two parties agree that the daily rental of each floorage square meter is (type of currency) (amount). In case of lease, the amount of monthly rental is 9500 (type of currency) (amount) (SAY: RMB ). In case of pre-lease, the monthly rental should be calculated according to the actual floorage specified in the delivery document of the commercial residential building for pre-lease.甲、乙双方约定,该房屋每月每平方米建筑面积租金为( 币) 元。【出租】月租金总计为(人民币) 9500 元。(大写: 万 玖 仟 伍 佰 拾元 角整)。【预租】月租金由甲、乙双方在预租商品房交付使用书中按实测建筑面积计算确定。The rental remains unchanged in one (years). From the (month/year), the two parties can alter the rental through communication. The matters concerned to the above should be specified in the complementary articles by the two parties.该房屋租金 壹 (年/月)内不变。自第 (年/月)起,双方可协商对租金进行调整。有关调整事宜由甲、乙双方在补充条款中约定。4.2 The rental should be paid by Party B as following method and procedure: .乙方支付租金的方式如下: 。Article 5 Security Depposit and Other Charges五、保证金和其他费用5.1 The two parties agree that on the date of delivery by Party A, Party B should pay the deposit as the amount to the rental of months to Party A, SAY (type of currency) (amount).甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为 贰 日的租金,即( 人民币) 壹万玖仟元。Party A should issue the receipt to Party B when receving the deposit.甲方收取保证金后应向乙方开具收款凭证。On expiration of the Contract, the residual of the deposit, deducting the fees and charges covered by Party B according to the contract, should be returned to Party B.租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外,剩余部分无息归还乙方。5.2 In the leasehold, the fees and charges resulting from the use of the said premises including water, electricity, gas, telecom, facilities, management,and ,etc. should be covered by (Party A/Party B). Other fees or charges should be covered by (Party A/Party B).使用该房屋所发生的水、电、煤气、通讯、设备、物业管理、 等费用由(甲方/乙方)承担,其他有关费用均由 (甲方/乙方)承担。5.3 The caluculation or apportion the method and date of payment of the fees and charges covered by (Party A/Party B) set forth in above article should be carried out as below: . (甲方/乙方)承担的上述费用,计算或分摊办法、支付方式和时间 按国家规定支付 。Article 6 Requirements to Use and Responsibility to Maintain of the Premises六、房屋使用要求和维修责任6.1 During the lease term, in case of any damage or malfunction of the premises and its facilities, Party B will notify Party A to maintain in time , and Party A should carry out the maintenance in one days after he receives the notification from Party B. In case of delay to maintain by Party A, Party B can maintain himself and the concerned fees is covered by Party A.租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方维修;甲方应在接到乙方通知后的 壹 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。6.2 During the lease term, Party B will use and take good care of the premises and its facilities in a properly way. In case the premises or its facilities is damaged or broken due to the imoroper or unreasonable use by Party B, Party B will hold the responsibility to repair. In case the Party B refuses to repair, Party A can do it himself with the fees covered by Party B.租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒不维修,甲方可代为维修,费用由乙方承担。6.3 During the lease term, Party A promose to keep the premises and its facilities in safety and good conditions. In case of examination and maintence of the premises, Party A will notify the Party B three in advance. During the process, Party B will offer certain cooperation. Party A will not change the normal use of the premises by Party B.租赁期间,甲方保证该房屋及其附属设施处于正常的可使用和安全的状态。甲方对该房屋进行检查、养护,应提前 叁 个月通知乙方。检查养护时,乙方应予以配合。甲方应减少对乙方使用该房屋的影响。6.4 Apart from the attachment 3 of this Contract, Party B should botain the written consent by Party A and get the authorization by related government as well to decoration the premises or add attached facilities and equipments. The ownership of those attached facilitiea or equipments and the obligation of the maintenance will be sipulated in written form by the two Parties.除本合同附件(三)外,乙方另需装修或者增设附属设施和设备的,应事先征得甲方的书面同意,按规定须向有关部门批准后,方可进行。乙方增设的附属设施和设备归属及其维修责任由甲、乙双方另行书面约定。Article 7 Conditions of the Premises when Return七、房屋返还时的状态7.1 Unless the renewing of the Contract with the consent by Party A, Party B should return the premises in the same days on the expiration of the lease term. In case of delay to renturn without the consent of Party A, Party B will hold the overdue fine of u 9500/30 Yuan/Meter (currency ) every overdue day.除甲方同意乙方续租外,乙方应在本合同的租期届满后的 当 日内返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应该按 9500/30 元/日( 人民 币)向甲方支付该房屋占有期间的使用费。7.2 When Party B returns the premises, he will promise to keep the premises in goog conditions. And the premises will be examined by Party A. The two Parties will settle the fees and charges that should be covered by them separately.乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收认可,并相互结清各自应当承担的费用。All Due Payments and refund of Deposit will be settle within one day.乙方返还房屋当日,结清各自费用后,甲方返还乙方押金贰个月。Article 8 Sublet, Transfer and Exchange八、转租、转让和交换8.1 Except that Party A approve Party B to sublet the premises in the supplementary articles of this Contract, Party B will not sulet the premises unless he got the written approval by Party A. However , Party B is not allowed to sublet the partition in the one premises.除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,需事先征得甲方的书面同意,方可将该房屋部分或全部转租给他人。但同一间居住房屋,不得分割转租。8.2 In case to sublet, Party B will sign the sublease contract with the sub-lessee, and also register in the Real Estate Trading Center or the Farm System Acceptance Office where the premises is located according to relative regulations.乙方转租该房屋,应按规定与接受转租方订立书面的转租合同。并按规定向规定向该房屋所在区、县房地产交易中心或农场系统受理处办理登记备案。8.3 During the lease term, Party B should get the written consent of Party A to sublease the premises to others or exchange, the aliened of the right of lease the premises will sign the contract about change of the principal party and continue to perform this Contract.在租赁期内,乙方将该房屋转让给他人承租或与他人承租的房屋进行交换,必须事先征得甲方书面同意。转让或交换后,该房屋承租权的受让人或交换人应与甲方签订租赁主体变更合同并继续履行本合同。8.4 During the lease term, in case Party A wants to sale the premises, he should notify Party B three months in advance, and in the same conditions, Party B has the right of preemption of the premises.在租赁期内,甲方如需出售该房屋,应提前三个月通知乙方。乙方在同等条件下有优先购买权。Article 9 Terms of Dissolution of the Contract九、解除本合同的条件9.1 The two Parties agree to terminate this Contract and hold no responsibility when the following conditions meet:甲乙双方同意在租赁期内,有下列情形之一的,本合同终止,双方互不承担责任:i) The Land-use Right of the premises is withdrawn in advance according to the law;该房屋占有范围内的土地使用权依法提前收回的;ii)The premises is expropriated by law for the public interest or the requirement of city construction;该房屋因社会公共利益被依法征用的或因城市建设需要被依法列入房屋拆迁许可范围的;iii)The premises is derogated, destroyed or authenticated as dangerous premises;该房屋毁损、灭失或者被鉴定为危险房屋的;iv)Party A has notified Party B that there is mortgage on the premises before lease and nou the right of mortgage is realized.甲方已告知乙方该房屋出租前已设定抵押,现被处分的。9.2 The two Parties agree that one party will written notify the other one to terminate the Contrace when the following conditions meet. And the default party should assume the default fine as times of the monthly rental. In case the breach of Contract results the damage of the other party and the default fine could not be equal to the damage, the default party will compensate the balance between the damage and the default fine:甲、乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反合同的一方,应向另一方按月租金的 贰 倍支付违约金;给对方造成损失的,支付违约金不足抵付一方损失的,还应赔偿造成的损失与违约金的差额部分:i) Party A does not deliver the primises in time and after the notification by Party B, he still does not perform in 7 days;甲方未按时交付该房屋,经乙方催告后 柒 日内仍未交付的;ii)The premises delivered by Party A does not comply with the provision in this Contract, which leads to fail to reach the aim of lease; or the premises delivered by Party A exists flaw to endanger the safety of Party B;甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或甲方交付的房屋存在缺陷,危及乙方安全的。iii) Party B changes the usage of the premises without the written consent of Party A so that the premises is damaged;乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的;iv) The main structure of the premises is broken due to Party Bs fault;因乙方原因造成房屋主体结构损坏的;v) Party B make bold to sublet, transfer the right of lease or exchange the premises with others;乙方擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋的;vi) Party B pays the rental overdue to half a months;乙方逾期不支付租金累计超过 半 月的;vii) Others: .其他: 。Article 10 Responsibility of Breaching the Contract十、违约责任10.1 In case of the flaw of the premises when delivering, Party A should repair it in 3 days after the delivery. If overdue,Party A agrees to reduce the rental.该房屋交付时存在缺陷的,甲方应自交付之日起的 叁 日内进行修复,渔区不修复的,甲方同意减少租金并变更有关租金条款。10.2 Party A should compensate the damage of Party B resulting from Party As fault that he does not notify Party B the mortgage or the restriction to transfer the premises before the lease.因甲方未告知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙方损失的,甲方应负责赔偿。10.3 During the lease term, Party A will compensate Party B the damage of bodies or property resulting from the broken of the premises by Party As delay to repair and maintain the premises.租赁期间,甲方不及时履行本合同约定维修、养护责任,致使房屋损坏,造成乙方财产损失或人身伤害的,甲方应承担赔偿责任。10.4 In case that Party A terminates the contract to claim back the premises in advance against the provision in this Contract in the lease term, Party A will assume the default fine as the times of the rental of days that he claim ahead, If the default fine is not equal to the damage of Party B, Party A will compensate the balande.租赁期间,非本合同规定的情况,甲方擅自解除本合同,提前收回该房屋的,甲方应按提前收回天数的租金的 倍向乙方支付违约金。若违约金不足抵付乙方损失的,甲方还应负责赔偿。10.5 Party A can claim (renew the original stste of the premises), in case that Party B decoration the premises or add attached facilities without the written consen of Party A or beyond the range and requirements of Party A.乙方未征得甲方书面同意或者超出甲方书面同意的范围和要求装修房屋或者增设附属设施的,甲方可以要求乙方 恢复房屋原状 恢复房屋原状/赔偿损失)。10.6 Party B return the premises against the provision of the Contract in the lease term ,Party A can take the security deposit, and if the deposit is not equal to the damage of Party A ,Party B will compensate it.租赁期间,非本合同规定的情况,乙方中途擅自退租的,乙方应按提前退最退租天数的租金的 倍向甲方支付违约金,若违约金不足抵付乙方损失的,乙方还应负责赔偿。甲方可从租赁保证金中抵扣,保证金不足抵扣的,不足部分则由乙方另行交付。Article 11 Miscellaneous十一、其他条款11.1 In case that Party A needs to mortgage the premises in the lease term, he will notify Party B in written and promise that after the mortgage, 30 days before the parties agree to deal with the premises by converting into noney ro selling off, Party A should ask Party B for the intention of purchase.租赁期间,甲方需抵押该房屋,应当书面告知乙方,并向乙方承诺该房屋抵押后当事人协议以折价、变卖方式处分该房屋前 30 日书面征询乙方购买该房屋的意见。12.1 The two Parties agree that 15 days after the signature of this Contract, Party A will resister in the Real Estate Trading Center or the Farm System Acceptance Office and apply for the certification of lease. In case of alternation or termination of this Contract, Party A (Party A/Party B) will deal with the proceedings of alternation in the original registration department in 15 days from the date of altermation or termination. Party A will hold all responsibilities of the lawsuits arising from his non-performance of registration or alternation. This Contract will take effedtive after its (signature/registration).本合同自双方签字/签字后 当日 生效,生效后的15日内,由甲方负责按规定向房屋所在地区、县房地产交易中心或农场系统受理处办理登记备案,领取房屋租赁登记备案证明;本合同经登记备案后,凡变更、终止本合同的,由 甲方 (甲方/乙方)负责在本合同变更终止之日起的15日内,向原登记机构办理变更、终止登记备案手续。因甲方未办理房屋租赁登记备案或变更、终止登记备案的,所引起的法律纠纷,由甲方承担一切责任。11.3 In case of matters not settled down in this Contract , the two Parties can stipulate supplementary items through the communication. Any supplementary article and annex is the integral part of this contract, and the words written into the blanks of this Contract, supplementary items and annex are equal valid with the letterpress printing words.本合同未尽事宜,经甲、乙双方协商一致,可订立补充条款。本合同补充条款及附件均为本合同不可分割的一部分,本合同及其补充条款和附件内空格部分填写的文字与铅印文字具有同等效力。11.4 Both Parties clearly learn their rights, obligations and responsibilities and agree to perform according to this Contract. In case of breaching by one party, the other one has the right to claim the compensation.甲、乙双方在签署本合同时,对各自的权利、义务、责任清楚明白,并愿按合同规定严格执行。如一方违反本合同,另一方有权按本合同规定索赔。11.5 Both parties will solve the disputes arising from execution of the contract through friendly consultation. In case the agteement cannot be reached, the dispute may be summit as below (the two Parties together may choose one):甲、乙双方在履行本合同过程中发生争议,应通过协商解决;协商解决不成的,双方同意选择下列第 二 种方式解决;i)Submit to the Arbitration committee;提交 仲裁委员会仲裁;ii) Sue to the court;依法向人民法院起诉;11.6 There are 2 originals of this Contract and its Annexes. Each Party will hold one original, Shanghai Real Estate Trading Center or the Farm System Acceptance Office will hold one, and the other one is held by .
