The seller will delegate field engineers from Sulzer Shanghai to supervise the installation of the delivered goods for a fix period of 7 man days traveling time excluded and certified that the installation is according to the SELLER s standards The cost is included in the CONTRACT price There will be one field engineer working 9hrs per shift per daytime which inclusive 1hr for lunch time 卖 skills level of the workmen availability of equipment and etc The number of days for the installation can be reduced by employing concurrent work at different sections in the column with multiples column internals 运 输 储 存 安 装 和 操 作 须 按 照 卖 方 与 塔 内 件 一 起 提 供 的 TRK 3035 指 导 手 册 进 行 When the erection and installation of the column are completed it must not deviate more than 0 3 from the vertical in operation measured from top to bottom flange to flange If the forces are sustained due to thermal expansion after starting up the verticality of the column must be checked while it is at operating of the column must meet the requirement 塔 绝 热 须 满 足 要 求 10 2 Trial run without the presence of the Seller 卖 方 代 表 不 在 场 的 考 核 Should the Buyer be satisfied that the guarantee has been fulfilled a Page 14 of 21 10 3 Trial run with a Seller representative present 卖 方 代 表 在 场 的 考 核 If the presence of a Seller s representative is required during the trial run the following conditions have to be fulfilled 如 果 在 性 能 考 核 期 间 需 要 卖 方 代 表 在 场 则 下 列 步 骤 必 须 完 成 All operating media such as but no limited to heating coolants electricity and control air and product must be available without cost to the Seller in sufficient and constant quantities and of the suitable quality 所 有 操 作 介 质 如 但 不 仅 限 于 供 热 冷 却 剂 供 电 供 气 及 产 品 必 须 足 量 稳 定 优 质 地 配 备 At least one Seller s representative will be present at the trial 在 性 能 考 核 期 间 至 少 有 一 位 卖 方 代 表 在 场 The principal operating parameters like pressure temperature gas load and product streams must be kept constant monitored continuously and recorded or logged The analyses must be made continuously and speedily and must entail no costs for the Seller 主 要 操 作 参 数 如 压 力 温 度 气 体 负 荷 和 产 品 流 量 必 须 保 持 稳 定 被 连 续 地 监 测 并 做 记 录 分 析 必 须 连 续 地 快 速 地 进 行 分 析 结 果 应 免 费 提 供 给 卖 方 If the measured results call into question the proof of performance the cause will be investigated as quickly as possible in collaboration with the Buyer The Seller is entitled to request contesting analyses by a neutral body acceptable to the Buyer The costs will be borne by the Seller only if the results show that the objection was not justified 如 果 卖 方 对 性 能 考 核 的 结 果 产 生 质 accessory equipment affecting the column operation evaporator condenser pumps vacuum installation control system etc must be employed appropriately for the process and must function properly 所 有 可 能 影 响 塔 操 作 的 辅 助 设 备 蒸 发 器 冷 凝 器 泵 真 空 装 置 控 制 系 统 等 在 性 能 考 核 过 程 中 必 须 使 用 正 确 且 运 转 正 常 The test run period shall be fixed at a total of 72 hours excluding traveling time 性 能 考 核 时 间 为 连 续 72 小 时 不 包 括 旅 途 时 间 10 4 Performance guarantee fulfilled 性 能 保 证 完 成 Based on design condition if the values guaranteed are kept stable and constant to the design value during the prescribed time the guarantee is considered fulfilled A report is then made of the successful guarantee trial stating that the performance guarantee has been fulfilled The report also contains the operating conditions and results noted during the guarantee trial Further it may include recommendations and suggestions for improvements in future plant operation The report must be signed by an authorized representative of the carried out within 12 months of unit starting to work the performance guarantee will be considered as fulfilled just the same 在 塔 安 装 后 要 尽 可 能 早 地 进 行 性 能 测 试 如 果 在 本 设 备 所 属 装 置 开 车 后 12 个 月 内 性 能 测 试 还 未 进 行 则 性 能 考 核 将 被 认 为 已 经 通 过 了 If buyer can not finish performance trial in 12 months of unit starting to work because of force majeure we should kindly discuss them to reach agreement 由 于 不 可 抗 力 因 素 造 成 买 方 无 法 在 开 车 后 12 个 月 内 进 行 性 能 测 试 由 双 方 协 商 解 决 10 5 Performance guarantee not fulfilled 性 能 保 证 未 完 成 The Buyer and the Seller will discuss the possible causes The Seller will be allowed the necessary time for possible modifications At the request of the Seller further trials will be made to ascertain the cause 如 果 设 计 制 造 达 不 到 工 艺 性 能 保 证 双 方 将 努 力 进 行 整 改 应 该 允 许 卖 方 有 必 要 的 时 间 做 可 能 的 改 进 并 进 行 进 一 步 的 测 试 以 便 弄 清 原 因 Should these trials not be successful due to products quality the Seller must supply additional packing or other internals till the guaranteed values both parties and if such damage is due to Seller s reasons such damages shall be remedied at the Seller s own expenses in such a way that the Equipment shall be corrected repaired or replaced by the SELLER 在安装 试运转和性能考核期间 发生任何设备的损坏 买卖双方应共同检查 而如果这种损坏 是由于卖方原因引起的 则这种损坏应由卖方自费处理 设备由卖方更正 修理或更换 In case a defect of Equipment is found due to the Buyer s fault the BUYER shall correct repair or replace the Equipment at his own expenses the SELLER shall be responsible to give his assistance 如果这种损坏是由于买方的原因 则买方应自费更正 修理或更换此设备 卖方有责任提供协助 12 2 The Mechanical Guarantee Period for the Goods excluding corrosion 个月或交货后 18 个月 以哪一 个先为准 12 3 During the Mechanical Guarantee period should any equipment be found defective and or not in conformity with the stipulations of the CONTRACT the BUYER shall notify the SELLER immediately by fax and if it is the Seller s fault the SELLER shall within 48hrs dispatched personal to the SITE for solving the problem 在担保期内 如发现有任何设备缺陷和 或不符合本合同规定 买方应立刻用传真通知卖方 如果 责任在卖方 卖方则需在 48 小时内派遣技术人员到现场以解决问题 12 4 If the SELLER is found to be responsible the SELLER shall at his own cost repair or replace the defective parts of the Equipment within such time limit to be mutually agreed by both parties 如果发现责任在卖方 卖方应在双方共同同意的限定时间内 自费修理或更换此设备有缺陷的部 件 With regard to minor defects of the Equipment for which the SELLER is responsible the BUYER may arrange repairing or replacement at the SELLER s expense with the consent in writing of both parties 对于卖方应负责的设备的微小缺陷 买方可以在双方书面同意情况下安排修理或更换 费用由卖 方承担 12 5 The Mechanical Guarantee period of any replaced Equipment shall be 12 months beginning on stream such replaced Equipment 任何更换设备的机械担保期应从更换开始后的 12 个月 12 6 The SELLER shall not be responsible for any defects occurring to the Equipment at any time which are due to the BUYER s reasons
