浙江省环境保护厅浙江省环境保护厅文件文件浙江省农业厅浙环发202126号关于进一步深化畜禽养殖污染防治加快生态畜牧业开展的假设干意见各市、县市、区环保局、农业局：为深入贯彻落实?浙江省人民政府办公厅关于进一步加强农村环境保护工作的意见?浙政办发2021111号和?浙江省农村环境保护规划?浙发改规划2021928号，促进畜牧业健康、可持续开展，保护和改善农村生态环境，推进社会主义新农村建设。现就进一步深化畜禽养殖污染防治，加快生态畜牧业开展提出如下意见：一、充分认识深化畜禽养殖污染防治，加快生态畜牧业开展的重要性和紧迫性加强畜禽养殖污染防治，推进生态畜牧业开展是农村环境保护工作的重要内容。自2005年以来，通过实施“811环境污染整治行动和“811环境保护新三年行动，全省存栏生猪200头牛20头以上的7800多个规模场户得到治理，嘉兴市已根本完成生猪50头以上养殖户的治理，畜禽排泄物资源化利用取得了积极进展，生态畜牧业开展态势良好。但是，我省畜牧业正处于转型升级的关键时期，畜牧业区域布局不平衡的问题还难以在短时间内得到根本改变，局部地区畜禽养殖总量增加与环境容量、土地种植消纳的矛盾仍然突出；畜禽养殖排泄物仍然是平原河网和局部流域水环境的污染源之一；一些地区畜禽养殖禁养区禁养制度尚未全面落实，局部畜禽养殖场污染治理设施与养殖规模不匹配、治理设施后续管理不到位。这些问题制约了畜牧业与农村环境保护的协调开展。各级环保、农业部门要充分认识深化畜禽养殖污染防治，加快生态畜牧业开展的重要性和紧迫性，切实加强组织领导，加大工作力度，不断创新工作举措，确保我省农村生态环境持续改善，畜牧业健康、稳定开展。二、明确总体目标要求，建立畜牧业生态化建设机制深入贯彻落实科学开展观，按照“农牧结合、科学布局、因地制宜、循环利用、控量减污的原那么，根据区域环境承载力，以满足土地消纳能力和水环境功能区达标为前提，以畜禽排泄物资源化利用为主要途径，通过建立健全区域和总量控制制度、优化畜禽养殖区域布局等措施，大力开展规模生态养殖，提高畜禽废弃物综合利用率。综合运用法律、经济、技术和必要的行政手段，加强畜禽养殖业环境监管，加快建立畜牧业生态化建设机制，促进畜禽养殖污染物减排，实现保障我省畜产品有效供应、改善农村环境质量的协调开展。到2021年，全面完成禁养区内养殖场的关停转迁，全面完成存栏生猪100头牛10头以上畜禽养殖场户畜禽排泄物治理与资源化利用，畜禽养殖排泄物在种植业中得到有效利用，畜禽养殖环境问题突出的村庄得到有效治理。太湖流域规模化畜禽养殖场排泄物综合利用率到达97%以上，畜禽养殖污染物排放总量削减15%。三、优化畜牧业区域布局，建立健全畜禽养殖区域控制制度一组织编制生态畜牧业开展规划。各级农业部门要会同环保等部门，依据本地区畜产品需求增长及环境承载力、流域水环境容量、生态环境状况以及禁养区规定，科学编制生态畜牧业开展规划。设区市以上畜牧业开展规划应进行环境影响评价。环保部门要会同农业部门做好规划的环境影响评价审查，从空间、总量环境准入上优化生态畜牧业开展。规划已进行环评的，区域内申报畜牧业工程的环评程序予以简化。二严格执行畜禽养殖禁养区和限养区制度。各县市、区农业部门会同环保部门，按照?中华人民共和国畜牧法?、?畜禽养殖污染防治管理方法?、?浙江省水污染防治条例?等规定，结合当地实际，科学划定禁养区、限养区范围，经县市、区人民政府批准后组织实施，并及时向社会公告。以下区域应当划定为畜禽养殖场、养殖小区的禁养区：生活饮用水水源保护区、风景名胜区、自然保护区的核心区及缓冲区；城镇居民区、文化教育科学研究区等人口集中区域；法律、法规规定的其他禁养区域。水环境功能确定为I、II类水质水体的流域上游含支流两侧500米范围；城镇规划区内的敏感区文化教育科学研究区等上风向1公里内，城镇规划区常年主导风向的上风向500米内。法律、法规、规章规定需特殊保护的其它区域。禁养区内禁止建设畜禽养殖场、养殖小区。经划定的禁养区内现有各类养殖场要限期关停、搬迁，具体关停、搬迁畜禽养殖场名录，由县级以上人民政府提出并报上一级农业、环保部门备案。由县级以上人民政府责令关停、搬迁的养殖场、养殖小区，应当予以损失评估及相应补偿。限养区内严格控制养殖规模，不得新建、扩建畜禽养殖场，已有的畜禽养殖场应当限期治理，确保排放水污染物符合国家或者省规定的排放标准；未经治理或未达标排放的，由县级以上人民政府环境保护行政主管部门责令限期治理。逾期未完成治理任务的，依法予以关闭。2021年11月底前，各设区市环保局、农业局将所辖县市、区政府划定和调整后的畜禽养殖禁养区方案报省环保厅、省农业厅备案。四、建立健全畜禽养殖污染物排放总量控制制度，促进畜禽排泄物减排增效一积极探索推广生态畜牧业开展模式。各地要将畜牧业生态化建设作为畜禽养殖减排增效的关键措施来抓，严格按“减量化、无害化、资源化的原那么，采用过程控制与末端治理相结合的方式，优先应用“就地结合、就地利用的“零排放模式，实现养殖排泄物全部资源化利用；畜禽粪便超过周边承载量的大、中型规模养殖场和专业生产区，应当在异地配套相应承载利用能力的种植业基地，建立畜禽肥水、沼液综合利用的中介效劳组织，采用异地资源化利用模式；平原、丘陵地带的中、小规模散养密集地区，那么宜采取分散与集中处理相结合的模式，畜禽粪便收集后发酵处理，养殖户一户或联户建立沼气池，沼液、沼渣收集后作肥料还田；积极引导散养密集区异地兴建生态小区或规模场，实现人畜别离，改善村庄环境；大型养殖场应创造条件，通过配套一定面积的综合性农、林、渔业生产区域，实现整个区域内资源循环、生态平衡。同时，积极鼓励各地创新畜禽排泄物资源化利用机制和开展模式，力争做到减排或零排放，促进畜牧业与种植业、农村生态建设协调开展。二建立畜禽养殖污染物排放总量削减替代制度。按照同区域“控量减污的原那么，根据畜禽养殖场资源化利用水平和土地消纳能力、水环境功能区达标等情况，合理控制养殖过载区域畜禽养殖总量。水环境质量不能到达功能区要求，化学需氧量、氨氮等指标超标且畜禽养殖过载的区域，当地政府要制定畜禽养殖总量逐年削减目标，不断提高畜禽养殖规模化水平，并积极采用新型生态养殖模式，加快畜牧产业转型升级。对未能完成年度削减任务的地区，暂停该区域内新增水污染物排放的畜牧业建设工程环评审批。从2021年开始，新建、扩建、改建的猪牛规模化养殖场户、小区，应削减一定比例的畜禽养殖污染物排放总量，削减指标优先支持本区域内有条件开展的生态养殖场小区与现代农业示范园区配套建设生态化牧场。嘉兴市要积极探索畜禽养殖污染物减排和排污权有偿使用机制，推进畜禽散养户关停并转，确保如期完成畜禽养殖总量削减任务。五、切实加强畜禽养殖业环境监管，促进生态畜牧业开展一严格执行畜禽养殖业环境准入制度。各地要按照建设工程环评审批分级管理权限规定，严格执行新建、扩建规模化畜禽养殖场小区、户环境影响评价的“三同时制度。未批先建且已建成的规模化畜禽养殖场，应按照法律、法规的要求处理，并在落实污染防治措施、完成限期治理任务及相关环保要求的前提下，依法补办相关审批手续。二加快推行畜禽养殖场排污许可及备案制度。各级环保部门要认真落实畜禽养殖场排污许可证制度。向环境排放畜禽养殖污水的规模化养殖场，应当按照国家和省有关规定申领排污许可证。各级畜牧兽医部门要加快落实畜禽养殖场小区备案制度，并及时掌握年存栏生猪100头以下养殖场户的名称、养殖地址、治理方式等情况，催促落实畜禽排泄物综合治理与资源化利用措施。规模化畜禽养殖场小区，必须按一场一档要求建立养殖档案，明确生产状况、排泄物治理与资源化利用状况。嘉兴等环境容量较小或农牧结合有困难的地区，要积极出台有机肥使用扶持政策，采用粪便集中收集处理和沼液深度处理、用槽罐车将沼液就近纳入污水处理设施进行处理等模式，实现畜禽污染物零排放或达标排放。三切实加大畜禽养殖业环境执法力度。各级环保部门要会同农业部门，采取专项督查和日常性监督等多种方式，依法查处畜禽养殖场的各种环境违法行为。2021年6月前，各市制定专项检查方案报省环保厅备案并抄送省农业厅，重点对“811环境污染整治行动开展以来已完成治理的规模场及畜禽粪便收集处理中心治理设施运行、管理和维护情况进行督查，确保治理设施正常有效运行。省环保厅、省农业厅将组织规模化畜禽养殖场环保专项执法检查，重点对年存栏生猪3000头以上养殖场的环境保护情况进行检查，对未批先建、污染治理与资源化利用不到位的规模化养殖场责令限期完成治理，并进行通报。建立有效的举报制度，发动群众对擅自向水体等环境排放畜禽养殖污染物的行为进行举报，强化社会监督。各地要逐步将规模化养殖场纳入环保部门监督监测的范围。本通知所指的规模化养殖场，按照?浙江省畜禽养殖污染物排放标准?DB33/593-2005确定的集约化畜禽养殖场适用规模标准执行，其它畜禽按相关标准折算。六、保障措施一加强制度建设。加强畜禽养殖排泄物资源化利用的政策、法规、规划和标准建设。省环保厅将会同有关部门积极开展地方性法规、规章的研究制订工作，制定?浙江省生猪养殖业环境准入指导意见?。各地要及时出台相关的政策措施，加大畜禽养殖排泄物治理与资源化利用的支持力度。省环保厅将在平湖等地组织开展畜禽养殖污染物排放总量和区域控制试点。二严格责任考核。各地要按照畜禽养殖区域控制和总量控制的要求，制定畜禽养殖污染防治方案。将畜禽养殖污染防治工作纳入各级生态建设考核的重要内容。对畜禽养殖污染防治工作不到位，污染严重的区域实行挂牌督办，生态建设考核不得评优，并在生态示范创立中一票否决。三强化政策扶持。各地要积极制定促进畜禽污染防治与畜禽排泄物资源化利用的环境经济政策，对规模化畜禽养殖场污染防治，特别是对畜禽排泄物资源化利用在申请财政补贴、贷款、污染防治补助等方面给予支持。对污染治理工作不积极、效果不明显或造成污染的畜禽养殖场户，取消有关专项资金申报资格。四加强技术指导。各地农业、环保部门要积极推广畜禽生态养殖、畜禽排泄物无害化处理和资源化、低本钱利用的典型和先进减排技术，要大力推广“两个别离干湿别离、雨污别离的治理方法和就地消纳、循环利用、集中收集处理、零排放等多种模式。积极引进国内外先进技术和科研成果，探索清洁养殖新技术。建立完善畜禽养殖场排泄物资源化利用的市场化效劳体系，实施试点示范工程，加快畜禽养殖污染治理、资源化利用与生态化养殖适用技术的推广应用，促进生态环境治理与畜牧业开展的和谐双赢。二一年五月四日主题词：环保 农业 畜禽 污染 防治 意见 抄送：省政府办公厅。 浙江省环境保护厅办公室2010年5月5日印发英文版 Two regulations promulgated for implementation is in the party in power for a long time and the rule of law conditions, the implementation of comprehensive strictly strategic plan, implementation in accordance with the rules and discipline to manage the party, strengthen inner-party supervision of major initiatives.
